Introduction

These Terms of Use (“Terms”) govern access to and use of publichunts.com and related PublicHunts services. By accessing or using PublicHunts, creating an account, or clicking an acceptance control where presented, you agree to these Terms and our Privacy Policy. If you do not agree, do not use PublicHunts.

1. Eligibility and the Service

You must be at least 13 years old to use PublicHunts. If you are below the age of legal majority where you live, use PublicHunts only with a parent or guardian’s involvement and permission. You represent that you can legally enter into these Terms.

PublicHunts provides tools that may help users discover public hunting lands; view property and administrative boundaries; review species, seasons, permits, regulations, and access information; search and filter properties; save properties and searches; receive alerts; follow official agency links; and plan outdoor activities. Features may be added, modified, suspended, or removed at any time.

2. Open-Beta Service

PublicHunts may be offered as an open-beta or prerelease service. During beta testing, features may be incomplete; information may be missing, delayed, outdated, or inaccurate; errors, interruptions, and data loss may occur; features may change without notice; and the service may be temporarily unavailable. You use beta features at your own risk.

3. Official Information Controls

PublicHunts is a discovery and research tool. It is not a government agency, law-enforcement authority, landowner, legal adviser, outfitter, or hunting-regulation authority. It may compile, summarize, transform, or link to information from agencies and other sources.

PublicHunts does not guarantee accuracy, completeness, timeliness, legal status, or suitability of property boundaries, ownership or access status, seasons, species availability, bag limits, weapon restrictions, permits, fees, closures, roads, trails, parking, weather, hazards, map coordinates, or other land or regulatory information.

Official agency publications, posted signs, landowner instructions, emergency orders, and applicable law control. Always verify information through the linked official agency or land-management source before entering property, traveling, hunting, or taking wildlife.

4. User Responsibility

You are solely responsible for determining whether an area is legally open and accessible; obtaining required licenses, permits, stamps, registrations, and permissions; complying with federal, state, tribal, and local laws; obeying signs, closures, seasons, bag limits, and weapon restrictions; confirming boundaries and avoiding trespass; determining whether access routes are open; using appropriate safety equipment; evaluating terrain, weather, wildlife, firearm, navigation, and outdoor hazards; and ensuring activities are appropriate for your experience and condition.

Never rely on PublicHunts as your only navigation, emergency, legal, regulatory, or safety resource.

5. Accounts and Acceptable Use

Some features require an account. You agree to provide accurate information, maintain account and sign-in security, promptly notify us of suspected unauthorized access, accept responsibility for activity through your account, and not create accounts by automated or deceptive means or impersonate another person. Clerk or supported identity providers may provide authentication and security functions.

You may not violate law; use PublicHunts to trespass, poach, harass wildlife, or facilitate illegal activity; disrupt the service; probe vulnerabilities without written permission; bypass controls or rate limits; introduce harmful code; scrape substantial portions without permission; impose unreasonable automated load; impersonate; submit false, unlawful, threatening, or abusive content; misuse reports; obtain another user’s information; or infringe rights. We may investigate violations and suspend or terminate access when appropriate.

6. User Submissions and Intellectual Property

You retain ownership of feedback, reports, corrections, notes, messages, and other content you submit. You grant PublicHunts a worldwide, nonexclusive, royalty-free license to host, store, reproduce, modify, analyze, and use submissions as reasonably necessary to operate and improve PublicHunts, investigate reports, correct data, respond to support requests, and protect the service and users. You represent that you may submit the content. Do not submit confidential information you do not want processed for these purposes.

PublicHunts’ original software, interface, branding, design, text, compilations, and other content are owned by PublicHunts or licensors. Government information and third-party materials may remain owned by their sources. Subject to these Terms, PublicHunts grants a limited, personal, revocable, nonexclusive, nontransferable right to use the service for lawful personal purposes.

7. Third Parties and Availability

PublicHunts may display or link to maps, regulations, authentication providers, agencies, and other third-party services. We do not control or take responsibility for third-party content, terms, privacy practices, availability, accuracy, security, or transactions and communications. Their terms govern your use.

We may change, restrict, suspend, or discontinue the service at any time. We do not guarantee availability, correction of errors, preservation of saved information, support for every device or jurisdiction, or coverage of every property or agency. Retain copies of information important to you.

8. Suspension and Termination

You may stop using PublicHunts at any time. We may restrict, suspend, or terminate access when we reasonably believe you violated these Terms, your use creates legal, security, safety, or operational risk, an account is involved in fraud or misuse, suspension is required by law, or continued service is impractical. Provisions that should survive termination—including intellectual property, disclaimers, limitations, and dispute provisions—remain effective.

9. Disclaimer of Warranties and Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PUBLICHUNTS IS PROVIDED “AS IS” AND “AS AVAILABLE.” PublicHunts disclaims all express and implied warranties, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, and reliability. We do not warrant that the service or its information will be accurate, complete, current, error-free, safe, or suitable. PublicHunts is not a substitute for official information, professional advice, field judgment, safety preparation, or legal compliance.

To the fullest extent permitted by law, PublicHunts and its owners, affiliates, contractors, providers, licensors, and representatives are not liable for indirect, incidental, special, consequential, exemplary, punitive, profit, data, goodwill, or use losses, including those related to reliance on maps, boundaries, regulations, access information, trespass, citations, fines, property damage, injury, death, hazards, account access, service interruption, data loss, or third-party services.

To the fullest extent permitted by law, total liability for all claims will not exceed the greater of amounts you paid PublicHunts in the 12 months before the event or one hundred United States dollars. Some jurisdictions do not permit certain exclusions or limits.

10. Indemnification, Governing Law, and General Terms

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless PublicHunts and its owners, affiliates, contractors, providers, licensors, and representatives from claims, liabilities, damages, losses, and reasonable expenses arising from your violation of these Terms, unlawful or unsafe conduct, violation of rights, submitted content, or misuse of PublicHunts, except where indemnification cannot legally be required.

These Terms are governed by Alabama law, without regard to conflict-of-law principles. Legal action arising from these Terms or PublicHunts must be brought in a state or federal court with jurisdiction in Alabama unless applicable law requires otherwise; you and PublicHunts consent to that jurisdiction.

If a provision is unenforceable, remaining provisions remain effective. Failure to enforce is not a waiver. You may not assign these Terms without written consent; PublicHunts may assign them in a merger, acquisition, restructuring, or transfer. These Terms and the Privacy Policy are the entire agreement except where another written agreement expressly applies.

11. Changes and Contact

We may update these Terms as PublicHunts changes. We will revise the effective date and may provide additional notice when required or when changes are material. Continued use after updated Terms become effective constitutes acceptance of the updated Terms.
